No charges will be brought forth against a Virginia homeowner who shot a teenager entering his home by mistake in March.

16-year-old Caleb Gordley who had snuck out of his home earlier that night to go drinking with friends, used a window to enter the wrong residence believing it to be his own.

The top prosecutor of Loudon County made the decision against filing charges due to evidence stating the assailant had given Gordley verbal warnings and a warning gun shot before fatally shooting the teenager in the shoulder.

Caleb was a member of the Park View High School varsity basketball team.

The decision to not file charges was announced Tuesday.
