The Supreme Court appears likely to preserve access to the abortion pill mifepristone, which is used in nearly two-thirds of abortions in the U.S. This decision would represent a significant setback for anti-abortion groups seeking to restrict the drug’s availability. The challenge to mifepristone’s FDA approval raised questions about the appropriate role of the judiciary in assessing medical and scientific evidence, typically handled by the FDA’s experts.

Justice Ketanji Brown Jackson highlighted the issue of whether judges should be the ones to parse through complex scientific data, a point echoed by other justices who were skeptical of the challengers’
arguments.
