49er’s player released after DUI arrest

Aldon Smith, linebacker for the San Francisco 49er’s, is a free man.

The NFL player was released Friday from Santa Clara County Jail on a $5,250 bail only hours after being arrested for driving under the influence.

Smith declined to comment on the case in which he reportedly swerved and hit a tree and took sobriety tests which determined he was under the influence.

Twenty-three-year-old Smith also had a prior arrest on suspicions of drunk driving in Miami Beach, January 2012.

Niner’s coach Jim Harbaugh commented on the case and the team’s upcoming game against the Indianapolis Colts.  “I expect Aldon – like today – he’ll be back to work and playing on Sunday.”

Harbaugh also mentioned that disciplinary action will more than likely come from the NFL.  “There will be consequences.  There always is.  Good or bad, we all have consequences.”

Smith is due in court November 4.
