NATIONAL NEWS – End to book ban? Federal Judge strikes down part of Florida’s DeSantis book ban law

A federal judge has ruled that a key provision of Florida’s controversial book ban law, championed by Gov. Ron DeSantis, is unconstitutional for being overly vague. U.S. District Judge Carlos Mendoza said the section banning books that “describe sexual conduct” fails to clearly define what content is prohibited, leading to the removal of classics and modern novels like The Handmaid’s Tale.

The decision is a major win for Penguin Random House, several authors, including John Green and Jodi Picoult, and the Authors Guild, who argued the law violated First Amendment protections. Mendoza rejected Florida’s claim that book removals amounted to “government speech,” saying the law instead stifled disfavored viewpoints.

While the order doesn’t strike down the entire statute, restrictions on pronoun use and the process for parents to object to school library books remain in place. Florida officials said they plan to appeal, calling it a “bad decision.” Free speech advocates, however, hailed the ruling as a sweeping victory for students’ right to read and access diverse ideas.
