Attorney General requests release of wrongly convicted man

The Virginia Court of Appeals has been approached by Attorney General Ken Cuccinelli in the case of a falsely accused prisoner.

Cuccinelli is requesting the release of Johnathan Montgomery who has served a four year prison term for sexual assault, in light of the alleged victim’s recant.

Elizabeth Paige Coast accused Montgomery of sexually assaulting her in 2000. At the time she was 10 and he was 14.

She has since recanted her allegations and Coast received a two month prison sentence for perjury.

Cuccinelli filed a brief with the court Thursday stating that Coast’s conviction provides evidence of Montgomery’s innocence.
