A Justice Department attorney revealed Monday that Kilmar Abrego Garcia could be deported before standing trial on human smuggling charges, contradicting earlier White House and DOJ statements. During a Maryland court hearing, officials said ICE would detain and potentially remove Abrego Garcia to a third country if released from jail.
His American wife is suing to prevent the deportation, following his mistaken removal to El Salvador earlier this year. The judge denied a government motion to dismiss the case and scheduled a hearing for Thursday to clarify next steps.
